INVITATION FOR BIDS
The Town of Haysi, Virginia, is inviting competitive sealed bids, in accordance with the Virginia Public Procurement Act, Sec. 2.2-4302.1, for the construction of the Haysi Riverfront Trail. These improvements include a series of retaining walls for a ramp to access the river, new stage area and a prefabricated structure, asphalt and concrete work, carpentry, electrical and lighting improvements, landscaping, new kiosks and foundation remediation of the town pavilion in the downtown area of Haysi.

Withdrawal of an errant bid may be allowed according to Sec. 2.2 – 4330, whereby the bidder shall give notice in writing of his claim of right to withdraw his bid within two business days after the conclusion of the bid opening procedure and shall submit original work papers with such notice.

The contract price will be a firm-fixed lump-sum price.

A bid guarantee, or bid bond, or 5% of the amount of the bid, is required, with the bid, in accordance with Sec. 2.2-4336.

One original and two (2) complete copies of the bid must be submitted in a sealed envelope/package marked “Haysi Riverfront Improvements Bid” and be received in the Town Office, Town Office 322 Main Street PO BOX 278 Haysi, VA 24256, no later than Thursday, April 21, 2022 at 2:00 p.m. at which time they will be opened publicly. No faxed or emailed bids will be accepted. Any bid received after the date and time specified will be returned to the bidder unopened.

The Town shall provide the mechanism for the evaluation of all information received. The Town reserves the right to make the final determination of responsible offerors and to waive the informalities and/or irregularities and to accept or reject any or all bids. Should the project exceed the available funds, the Owner will negotiate with the apparent low bidder to attempt to bring the project into budget before initiating a contract, pursuant to Sec. 2.2-4318. Responsible bidders will hold a Class A Virginia Contractors’ license and meet responsibility requirements of HUD regulation 24 CFR Part 85.

This is a federally assisted project. Bidders and contractors performing work under this advertisement are bound by the requirements of President’s Executive Order 11246 as amended by Executive Order 11375; Title VI of the Civil Rights Act of 1964; Section 109 of Title 1 of the Housing and Community Development Act of 1974, as amended; Section 3 of the Housing and Urban Development Act of 1968; the Immigration Reform and Control Act of 1986; the Davis-Bacon Act; the Copeland “Anti Kickback” Act; the Contract Work Hours and Safety Standards Act; and Public Law 100 202. The bidder’s attention is called to the “Equal Opportunity Clause” and the goals and timetables for minority and female participation in each trade and to the fact that not less than minimum wages set forth in the contract documents must be paid.

Partial funding for the project is being provided by the Recreational Trails Program of the Federal Highway Administration administered in Virginia by DCR and must be undertaken in accordance with the Recreational Trails Program guidance of the FHWA and the with 2, 23 and 49 CFR.

Partial funding for the project is also being provided by the Appalachian Regional Commission (ARC).
